By accessing or using the NxQure platform ("Service"), operated by NxQure ("we", "our", or "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms apply to all users including healthcare providers, patients, marketing agents, and visitors.

2. Description of Service

NxQure is an AI-powered platform for hospitals and healthcare providers that includes:

  • AI-assisted patient engagement via WhatsApp, web, and video.
  • Appointment booking and follow-up management.
  • Patient health portals with medical records access.
  • Social media marketing management and automation.
  • Lead generation and conversion pipeline tools.
  • Analytics dashboards and reporting.

3. User Accounts

  • Patient accounts are created by healthcare providers. Patients receive login credentials from their hospital or clinic.
  • Healthcare provider and marketing agent accounts are provisioned by NxQure or authorized administrators.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You must notify us immediately of any unauthorized use of your account.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of applicable regulations.
  • Attempt to gain unauthorized access to any part of the Service.
  • Transmit malicious code, spam, or harmful content.
  • Impersonate another person or entity.
  • Interfere with or disrupt the Service or its infrastructure.
  • Attempt to extract data through scraping, crawling, or automated means without authorization.
  • Use the AI features to generate misleading medical advice or harmful content.

5. Medical Disclaimer

NxQure is not a substitute for professional medical advice, diagnosis, or treatment. The AI assistant provides informational support only. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay seeking it because of something you read or received through the Service. In case of a medical emergency, call emergency services immediately.

6. Intellectual Property

The Service, including its software, design, content, and branding, is owned by NxQure and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended purpose. You may not copy, modify, distribute, or reverse-engineer any part of the Service.

7. Third-Party Integrations

The Service integrates with third-party platforms including Google, Meta (Facebook, Instagram, WhatsApp), and others. Your use of these integrations is subject to the respective third-party terms and policies. We are not responsible for the availability, accuracy, or practices of third-party services. When you authorize OAuth connections, you grant us permission to access and manage the specific resources you approve.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Service, you consent to our data practices as described in the Privacy Policy.

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any loss or damage arising from service interruptions.

10. Limitation of Liability

To the maximum extent permitted by law, NxQure shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless NxQure, its officers, directors, employees, and agents from any claims, liabilities, damages, or expenses arising from your use of the Service or violation of these Terms.

12. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will remain in effect.

13. Governing Law

These Terms are governed by the laws of India. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in Hyderabad, Telangana, India.

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the revised Terms.
